Participant Agreement, Release and Assumption Of Risk
In consideration of the services, activities or related events of Treasure Coast Kayaking, LLC., there agents, owners, officers, employees, participants, and all other persons or entities acting in any capacity on their behalf the undersigned hereby agrees to the following:
_____1. Prior to Participating, I will inspect the vehicles, launch area and any equiptment to be used. If I believe anything is unsafe, I will immediately advise the agent or employee of Treasure Coast Kayaking, LLC. of the existence of such condition(s) and refuse to participate.
_____2. I acknowledge and fully understand that I will be engaging in activities that involve risk of damage to personal property, or serious injury, including permanent disability and death, and severe social and economic losses which might result not only from my own actions, inactions or negligence, but the actions, inactions or negligence of others, as a result of kayaking, fishing, wading in the water and swimming. The risks including but not limited to the perils of the sea and waterways, boat capsize and entrapment, acts of other participants, adverse sea and weather conditions, exposure to sun, strong wind, cold, storms, large waves, lightning, currents, aggressive and or poisonous marine life or wild life; repetitive motion injuries, slip and fall injuries. Futher, there may be other risks not known or not reasonably foreseeable at this time.
_____3. I hereby expressly agree and promise to accept and assume complete responsibility and liability for all risks existing in this activity. My participation in this activity is purely voluntary, and I elect to participate in spite of the risks.
_____4. I hereby voluntarily release, forever discharge, and agree to indemnify and hold harmless Treasure Coast Kayaking, LLC., its directors, agents, employees or any other individual in any way associated with Treasure Coast Kayaking, LLC., all of which are hereinafter referred to as "Releasees", from any and all liability to me, my heirs and next of kin for any and all claims, demands, losses or damages on account of injury, including death or damage to property, caused or alleged to be caused in whole or in part by the negligence or any other actions of the Releasees or otherwise.
_____ 5. I certify that I have adequate insurance to cover any injury or damage I may cause or suffer while participating, or else I agree to bear the cost of such injury or damage myself. I futher certify that I am willing to assume the risk of any medical or physical condition I may have.
_____6. This agreement, release and assumption of risk document may not be modified in any way. If any part of this agreement is determined to be invalid by law, all other parts of this document shall remain valid and enforceable.
_____7. I hereby warrant and represent that I am over 18 years of age and that I have rear and initialed each and every paragraph thereto and understand that I have given up substantial rights by having signed this PARTICIPANT AGREEMENT, RELEASE, AND ASSUMPTION OF RISK freely and voluntarily. By signing this document, I acknowledge that if anyone is hurt or property is damaged during my participation in this activity, I may be found by a court of law to have waived my right to maintain a lawsuit against Treasure Coast Kayaking, LLC. on the basis of any claim from which I have released them herein. I also agree to pay for any damages to the kayak and the equiptment that I have rented.
I have had sufficient opportunity to read this entire document. I have read and understood it, and agree to be bound by its terms.

PARENTS OR GUARDIANS ADDITIONAL INDEMNIFICATION
In consideration of ____________________________________________________________(print minor's name) ("Minor") being permitted by Treasure Coast Kayaking, LLC, to participate in its activities and to use its equiptment and facilities, I further agree to indemnify and hold harmless Treasure Coast Kayaking, LLC. from any and all claims which are brought by, or on behalf of Minor, and which are in any way connected with such use or participation by Minor.
